Momenta Music creates personalised music and digital music products for occasions including weddings, birthdays, anniversaries, Valentine's Day, memorials, funerals, celebrations, encouragement, sporting events, humorous roasts and other personal occasions.

We may also offer completed original songs and other digital music through collections such as the Founder's Collection.

Customers may provide information including:

• Names
• Personal stories
• Memories
• Dates
• Relationships
• Messages
• Lyrics
• Musical preferences
• Photos
• Documents
• Audio or other information

This information may be used to create the requested personalised song.

Customers are responsible for checking that information submitted to Momenta Music is accurate.

Momenta Music is not responsible for errors contained in information supplied by the customer.

Customers may choose to:

• provide their own lyrics; or
• ask Momenta Music to create lyrics based on their story and information.

Where customers provide lyrics, they confirm that they own those lyrics or have permission to use them.

Customers must not knowingly provide copyrighted material belonging to another person without appropriate permission.

Personalised music is a creative service.

By ordering a personalised song, customers acknowledge that musical composition, vocal style, instrumentation, arrangement, wording and interpretation involve creative decisions.

Momenta Music will make reasonable efforts to follow the customer's requested story, mood, genre and important details but cannot guarantee that every creative preference will be interpreted exactly as imagined.

Momenta Music may use artificial intelligence and other digital production technologies as part of the creative process.

These technologies may assist with areas including songwriting, composition, vocals, instrumentation, arrangement, audio production, artwork and other creative elements.

Momenta Music remains responsible for managing the customer's order and delivering the agreed service.

By ordering, customers acknowledge and consent to the use of these technologies in producing their personalised music.

Personalised song packages may include a stated number of revisions.

A revision may include reasonable changes to lyrics, names, wording or other agreed elements.

A revision does not necessarily include creating an entirely new song, changing the complete musical genre or restarting production after the original customer instructions have been followed.

Additional or substantial changes may incur an additional fee. Any additional charge will be disclosed before additional work begins.

Estimated delivery times displayed on the website are estimates unless Momenta Music expressly agrees to a specific guaranteed delivery date. Delivery times may vary depending on:

• complexity of the order
• customer response times
• requested revisions
• technical issues
• demand
• circumstances outside our reasonable control.

Customers purchasing music for a wedding, funeral, birthday or other date-specific event should provide sufficient time for production and revisions.

Where available, priority or urgent production may incur an additional charge.

Acceptance of an urgent order will depend on production capacity.

Any specific guaranteed deadline must be expressly confirmed by Momenta Music.

Prices are displayed in Australian dollars unless stated otherwise.

Payments may be processed securely through third-party payment providers such as Stripe.

Available payment methods may include credit/debit cards, Apple Pay, Google Pay and other payment methods supported by the payment provider.

Momenta Music does not directly store customers' complete payment card details.

Because personalised songs are created specifically for an individual customer, change-of-mind cancellations may not be available once production has commenced.

If production has not commenced, customers should contact Momenta Music as soon as possible to request cancellation.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

If there is a problem with a delivered song or service, please contact Momenta Music and provide details of the issue.

We will assess the matter and, where appropriate, may correct the issue, provide a revision, replacement, refund or another remedy.

Your rights under the Australian Consumer Law continue to apply.

Customers must not:

• resell the digital file;
• redistribute it commercially;
• upload it for resale;
• claim authorship or ownership of Momenta Music's underlying work; or
• make the file available for mass public download.

Completed songs sold through the Founder's Collection or other instant-download sections are digital products.

After successful payment, customers may receive access to download the purchased audio file.

Unless otherwise stated, purchasing a digital song provides a personal-use licence rather than ownership of the underlying copyright.

Customers may use their completed personalised song for personal purposes including:

• weddings
• funerals
• memorials
• birthdays
• anniversaries
• private celebrations
• personal social media
• family videos
• personal keepsakes.

Commercial use, advertising, resale, synchronisation, monetised distribution or other commercial exploitation may require separate written permission or licensing from Momenta Music.

Unless otherwise expressly agreed in writing, Momenta Music retains rights in its original creative work to the extent permitted by applicable law and subject to any rights belonging to third-party technology providers or licensors.

Customers retain ownership of original material they provide to Momenta Music.

Nothing in these Terms transfers ownership of customer-supplied photographs, stories, recordings or original lyrics to Momenta Music.

By submitting material to Momenta Music, the customer grants Momenta Music permission to use that material solely as reasonably necessary to create, administer and deliver the customer's order and provide related support.

The customer confirms that they have the necessary rights or permission to submit that material.

Personalised songs can contain sensitive and emotional personal information.

Momenta Music will take reasonable steps to handle customer information responsibly and in accordance with its Privacy Policy and applicable law.

Customers should avoid submitting information that is unnecessary for creation of their song.

Momenta Music will not intentionally publish a customer's private personalised song as a public sample without appropriate permission.

Where permission is obtained, Momenta Music may use agreed excerpts, audio, artwork or testimonials for promotional purposes.

Customers may decline such permission.

Momenta Music recognises that memorial, funeral, illness, grief and support songs may involve deeply personal circumstances.

We will make reasonable efforts to treat this information respectfully.

Customers should ensure that they have appropriate permission before providing sensitive personal information about another living person.

Customers requesting humorous or roast songs are responsible for the personal information they provide.

Momenta Music may decline requests containing unlawful, threatening, seriously abusive, discriminatory or otherwise inappropriate material.

Wedding or event packages may contain multiple songs designed for different stages of an event.

The exact number of songs, inclusions, revisions, delivery arrangements and price will be shown in the package selected at the time of purchase.

Momenta Music may use third-party services for payment processing, hosting, file storage, email delivery, music production and other technology.

Availability of these services may occasionally be affected by circumstances outside Momenta Music's reasonable control.

We aim to keep the Momenta Music website and digital services available, but uninterrupted availability cannot be guaranteed.

Maintenance, internet outages, hosting failures or other technical circumstances may temporarily affect access.

To the maximum extent permitted by law, Momenta Music will not be liable for indirect or consequential loss arising from use of the website or services.

Nothing in these Terms excludes or limits liability or consumer rights where doing so would be unlawful, including rights under the Australian Consumer Law.

Momenta Music may update these Terms & Conditions from time to time.

The version applying to an order will generally be the version in effect when the order was placed, unless applicable law requires otherwise.

The latest version will be published on the Momenta Music website.

These Terms & Conditions are governed by the laws of Queensland, Australia and applicable Commonwealth laws of Australia.
